Durchführungsbeschluss (EU) 2017/2175 der Kommission vom 21. November 2017 zur Änderung des Anhangs des Durchführungsbeschlusses (EU) 2017/247 betreffend Maßnahmen zum Schutz vor Ausbrüchen der hochpathogenen Aviären Influenza in bestimmten Mitgliedstaaten

Die Europäische Kommission -

gestützt auf den Vertrag über die Arbeitsweise der Europäischen Union,

gestützt auf die Richtlinie 89/662/EWG des Rates vom 11. Dezember 1989 zur Regelung der veterinärrechtlichen Kontrollen im innergemeinschaftlichen Handel im Hinblick auf den gemeinsamen Binnenmarkt 1, insbesondere auf Artikel 9 Absatz 4,

gestützt auf die Richtlinie 90/425/EWG des Rates vom 26. Juni 1990 zur Regelung der veterinärrechtlichen und tierzüchterischen Kontrollen im innergemeinschaftlichen Handel mit lebenden Tieren und Erzeugnissen im Hinblick auf den Binnenmarkt 2, insbesondere auf Artikel 10 Absatz 4,

in Erwägung nachstehender Gründe:

(1) Der Durchführungsbeschluss (EU) 2017/247 der Kommission 3 wurde erlassen, nachdem in mehreren Mitgliedstaaten (im Folgenden die "betroffenen Mitgliedstaaten") Ausbrüche der hochpathogenen Aviären Influenza des Subtyps H5 festgestellt sowie von den zuständigen Behörden der betroffenen Mitgliedstaaten Schutz- und Überwachungszonen gemäß Artikel 16 Absatz 1 der Richtlinie 2005/94/EG des Rates 4 abgegrenzt worden waren.

(2) Gemäß Durchführungsbeschluss (EU) 2017/247 müssen die von den zuständigen Behörden der betroffenen Mitgliedstaaten gemäß der Richtlinie 2005/94/EG abgegrenzten Schutz- und Überwachungszonen mindestens die im Anhang des genannten Durchführungsbeschlusses als Schutz- bzw. Überwachungszonen aufgeführten Gebiete umfassen. In dem Durchführungsbeschluss (EU) 2017/247 ist auch festgelegt, dass die in den Schutz- und Überwachungszonen anzuwendenden Maßnahmen gemäß Artikel 29 Absatz 1 und Artikel 31 der Richtlinie 2005/94/EG mindestens bis zu dem Zeitpunkt beizubehalten sind, der im Anhang des genannten Durchführungsbeschlusses für diese Zonen festgelegt wurde.

(3) Seit seinem Erlass ist der Durchführungsbeschluss (EU) 2017/247 mehrmals geändert worden, um den Entwicklungen der Seuchenlage in der Union im Hinblick auf die Aviäre Influenza Rechnung zu tragen. So wurde insbesondere der Durchführungsbeschluss (EU) 2017/247 mit dem Durchführungsbeschluss (EU) 2017/696 der Kommission 5 dahin gehend geändert, dass Bestimmungen für den Versand von Sendungen von Eintagsküken aus den im Anhang des Durchführungsbeschlusses (EU) 2017/247 aufgeführten Gebieten festgelegt wurden. Mit dieser Änderung wurde der Tatsache Rechnung getragen, dass das Risiko der Ausbreitung der hochpathogenen Aviären Influenza durch Eintagsküken im Vergleich zu anderen Geflügelwaren sehr gering ist.

(4) Der Durchführungsbeschluss (EU) 2017/247 wurde später auch durch den Durchführungsbeschluss (EU) 2017/1841 der Kommission 6 geändert, um die Seuchenbekämpfungsmaßnahmen zu verschärfen, die anzuwenden sind, wenn ein erhöhtes Risiko für die Ausbreitung der hochpathogen Aviären Influenza besteht. Dementsprechend ist im Durchführungsbeschluss (EU) 2017/247 nun festgeschrieben, dass nach einem Ausbruch oder Ausbrüchen der hochpathogenen Aviären Influenza auf Unionsebene weitere Restriktionsgebiete gemäß Artikel 16 Absatz 4 der Richtlinie 2005/94/EG in den betroffenen Mitgliedstaaten abgegrenzt werden; die Dauer der dort anzuwenden Maßnahmen ist ebenfalls geregelt. In dem Durchführungsbeschluss (EU) 2017/247 sind nun ebenfalls Bestimmungen für den Versand von lebendem Geflügel, Eintagsküken und Bruteiern aus den weiteren Restriktionsgebieten in andere Mitgliedstaaten unter bestimmten Voraussetzungen festgelegt.

(5) Der Anhang des Durchführungsbeschlusses (EU) 2017/247 wurde zudem mehrmals geändert, in erster Linie, um neuen Festlegungen der von den betroffenen Mitgliedstaaten gemäß der Richtlinie 2005/94/EG abgegrenzten Schutz- und Überwachungszonen Rechnung zu tragen. Der Anhang des Durchführungsbeschlusseses (EU) 2017/247 wurde zuletzt mit dem Durchführungsbeschluss (EU) 2017/2000 der Kommission 7 geändert, nachdem Italien der Kommission neue Ausbrüche der hochpathogenen Aviären Influenza des Subtyps H5N8 in Geflügelhaltungsbetrieben in der Region Lombardei gemeldet hatte. Italien meldete der Kommission außerdem, dass es nach diesen Ausbrüchen die gemäß der Richtlinie 2005/94/EG erforderlichen Maßnahmen, einschließlich der Abgrenzung von Schutz- und Überwachungszonen um die betroffenen Geflügelhaltungsbetriebe herum, ergriffen hat.

(6) Seit dem Zeitpunkt der letzten Änderung des Durchführungsbeschlusses (EU) 2017/247 durch den Durchführungsbeschluss (EU) 2017/2000 hat Bulgarien der Kommission zwei aktuelle Ausbrüche der hochpathogenen Aviären Influenza des Subtyps H5N8 in Geflügelhaltungsbetrieben in den Regionen Sliwen und Jambol gemeldet. Bulgarien hat der Kommission außerdem gemeldet, dass es nach diesen jüngsten Ausbrüchen die gemäß der Richtlinie 2005/94/EG erforderlichen Maßnahmen, einschließlich der Abgrenzung von Schutz- und Überwachungszonen um alle betroffenen Geflügelhaltungsbetriebe herum, ergriffen hat.

(7) Darüber hinaus hat Italien der Kommission weitere Ausbrüche der hochpathogenen Aviären Influenza des Subtyps H5N8 in Geflügelhaltungsbetrieben in den Regionen Lombardei, Piemont und Latium gemeldet. Italien hat der Kommission außerdem gemeldet, dass es nach diesen jüngsten Ausbrüchen die gemäß der Richtlinie 2005/94/EG erforderlichen Maßnahmen, einschließlich der Abgrenzung von Schutz- und Überwachungszonen um alle betroffenen Geflügelhaltungsbetriebe herum und der Erweiterung des festgelegten weiteren Restriktionsgebiets, ergriffen hat.

(8) Die Kommission hat die Maßnahmen geprüft, die Bulgarien und Italien nach den jüngsten Ausbrüchen der hochpathogenen Aviären Influenza in diesen Mitgliedstaaten gemäß der Richtlinie 2005/94/EG ergriffen haben, und sich davon überzeugt, dass die Grenzen der von den zuständigen Behörden dieser beiden Mitgliedstaaten abgegrenzten Schutz- und Überwachungszonen in ausreichender Entfernung von allen Geflügelhaltungsbetrieben verlaufen, in denen ein Ausbruch der hochpathogenen Aviären Influenza des Subtyps H5N8 bestätigt wurde. Die Kommission hat auch die Grenzen der von der zuständigen Behörde in Italien nach den jüngsten Ausbrüchen in diesem Mitgliedstaat festgelegten weiteren Restriktionsgebiete geprüft und sich davon überzeugt, dass der durch die Erweiterung dieser weiteren Restriktionsgebiete abgedeckte Umfang unter Berücksichtigung der aktuellen Seuchenlage in Italien ausreichend ist.

(9) Um unnötige Störungen des Handels innerhalb der Union zu verhindern und von Drittländern auferlegte ungerechtfertigte Handelshemmnisse zu vermeiden, ist es in Anbetracht der jüngsten Ausbrüche der hochpathogenen Aviären Influenza in Bulgarien und Italien notwendig, die gemäß der Richtlinie 2005/94/EG in diesen beiden Mitgliedstaaten abgegrenzten Schutz- und Überwachungszonen und die in Italien abgegrenzten erweiterten weiteren Restriktionsgebiete in Zusammenarbeit mit diesen Mitgliedstaaten rasch auf Unionsebene auszuweisen. Deshalb sollten die Einträge für Bulgarien und Italien im Anhang des Durchführungsbeschlusses (EU) 2017/247 aktualisiert werden, um der derzeitigen Lage in Bezug auf diese Seuche in diesen Mitgliedstaaten Rechnung zu tragen. Insbesondere sollten neue Einträge für die Schutz- und Überwachungszonen in Bulgarien und Italien und für die erweiterten weiteren Restriktionsgebiete in Italien, die derzeit Beschränkungen gemäß der Richtlinie 2005/94/EG unterliegen, in die Listen im Anhang des Durchführungsbeschlusses (EU) 2017/247 aufgenommen werden.

(10) Der Anhang des Durchführungsbeschlusses (EU) 2017/247 sollte nach den jüngsten Ausbrüchen der hochpathogenen Aviären Influenza in Bulgarien und Italien daher geändert werden, um die Regionalisierung auf Unionsebene dahin gehend zu aktualisieren, dass die gemäß der Richtlinie 2005/94/EG in diesen Mitgliedstaaten abgegrenzten Schutz- und Überwachungszonen und die in Italien abgegrenzten weiteren Restriktionsgebiete sowie die Dauer der dort geltenden Beschränkungen aufgenommen werden.

(11) Der Durchführungsbeschluss (EU) 2017/247 sollte daher entsprechend geändert werden.

(12) Die in diesem Beschluss vorgesehenen Maßnahmen entsprechen der Stellungnahme des Ständigen Ausschusses für Pflanzen, Tiere, Lebensmittel und Futtermittel

- hat folgenden Beschluss erlassen:

Artikel 1

Der Anhang des Durchführungsbeschlusses (EU) 2017/247 wird gemäß dem Anhang des vorliegenden Beschlusses geändert.

Artikel 2

Dieser Beschluss ist an die Mitgliedstaaten gerichtet.
